These terms are an agreement between you and (“DomainSouq”, “we”). By creating an account, placing an order or using our services, you accept them.
1. Accounts
- You must be at least 18 and able to enter a binding contract.
- Give us accurate details and keep them up to date, including the registrant details of every domain. False or outdated registrant details can lead a registry to suspend or delete a domain.
- You are responsible for everything done through your account. Keep your password private, and use two-step verification.
- Guest purchases create an account linked to your email. You set the password from the link we send after payment.
2. Prices and payment
- Prices are shown before you pay and include any applicable tax. They may change for future orders and renewals, but an order you have already paid for is not affected.
- You pay on our secure payment provider’s page. We never receive your card number.
- An order is confirmed only once the payment provider confirms the payment.
- We check domain availability, ownership and coupon validity again just before payment. If anything has changed, the order may be stopped or refunded.
- Coupons and offers have their own conditions (eligible extensions, minimum term, number of uses) and cannot be exchanged for cash.
3. Domain registration
- A domain is registered for the term you pay for. You get the right to use it during that term; you do not own it permanently.
- Every domain is subject to the rules of its registry and, for generic extensions, ICANN’s policies, including the Registrants’ Benefits and Responsibilities. Some country extensions (for example .ae, .sa, .qa, .eg) have extra eligibility rules or document requirements. You are responsible for meeting them.
- Registration is not final until the registry accepts it. If it fails, we refund you in full.
- Premium or misspelled names: a search result or appraisal is not a guarantee. Registries can refuse a name or change premium prices.
4. Renewals and expiry
- If you turn on automatic renewal, we charge your saved card shortly before the renewal date. Before charging, we confirm the domain or plan with the provider. You can turn automatic renewal off at any time under My Account.
- We send reminders before expiry, but renewing on time is your responsibility. After expiry, a domain may stop working and enter a grace or redemption period. Restoring it may cost extra, as set by the registry, and after that it may become available to anyone.
5. Transfers
- To transfer a domain in, it must be unlocked and you need a valid transfer code from the current registrar. Most transfers add one year to the term.
- You can get your transfer code under My Account at any time, unless the domain is in its first 60 days after registration or a transfer or owner change, is under a dispute or abuse case, or your account is on hold.
- Transfers can take up to [5–7] days, and the registry or the current registrar may reject them.
6. Hosting, email and SSL
- WordPress hosting: runs on our infrastructure partner’s servers within each plan’s limits. You are responsible for your website’s content, its plugins and themes, and your backups. Hosting renews like domains; you can switch automatic renewal off. If a plan ends, its websites may be deleted after notice.
- Business email: mailboxes are billed for as long as they exist.
- SSL certificates: need the validation the certificate authority asks for (DNS, email or file). We never ask for or store your private key.
7. Acceptable use
You must not use our services for illegal content, phishing, malware, spam, fraud, infringing someone else’s trademarks or copyright, or anything that breaks a registry’s rules. We may suspend services, lock domains or end accounts that do, as required by law or registry policy. You can report abuse to [abuse@domainsouq.com].
8. Domain disputes
Disputes over a domain’s rights are decided under the registry’s dispute policy (for example ICANN’s UDRP for generic extensions) or by a competent court. We will follow their decisions.
9. Refunds and cancellations
- Domain registrations, renewals and transfers usually cannot be refunded once the registry has processed them, and a refund never cancels or removes a domain. If we fail to register or transfer a domain you paid for, you get a full refund.
- For hosting, email and SSL refunds: [state your policy, e.g. “within 30 days of the first purchase”].
- If you dispute a charge with your bank (a chargeback), your account is put on hold and the domains in that order are locked until it is resolved.
10. Marketplace and free tools
- Marketplace listings are offers made by their owners. A request to buy is not a sale; terms and payment are agreed directly between you and the seller.
- Appraisals, name ideas and availability results are for guidance only. They are not financial advice and not a guarantee of value or availability.
11. Liability
We provide our services with reasonable care, but we do not guarantee that they will always be available or error-free. Many of them depend on registries and providers outside our control. To the fullest extent the law allows, we are not liable for indirect losses or loss of profit, data or business. Our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow us to limit.
12. Suspension and termination
You can close your account at any time once nothing is outstanding. Domains stay registered until they expire unless you transfer them out first. We may suspend or end services if you break these terms, do not pay, or if the law or a registry requires it.
13. Changes, law and contact
We may update these terms. Significant changes will be emailed to account holders before they apply. These terms are governed by the laws of [jurisdiction], and the courts of [city] have jurisdiction. If there is any difference between the Arabic and English versions, the [Arabic/English] version prevails.
